Acceptance of These Terms

Whisper is a detective game operated by SmartMove ("we", "our", "us"). By downloading or using Whisper, you agree to these Terms. If you do not agree, do not use the app.

What Whisper Is

Whisper hands you a copy of a fictional suspect’s phone. You answer questions about a case by looking through the apps, messages, photos, and records on that phone.

Everything in a case is fiction. The people, conversations, transactions, places, and events are invented for the story. No real person’s data appears in Whisper, and nothing in a case is a real record of anything. Any third-party names or marks that appear inside a case are the property of their respective owners; their appearance is part of the fiction and does not imply any affiliation with, sponsorship by, or endorsement from those owners.

Who May Use It

Whisper tells stories written for adults and is not directed to children under 13. You must be at least 13 years old to use the app, and old enough under the age rating shown on your app store. If you are a minor where you live, you may use Whisper only with the consent of a parent or guardian who agrees to these Terms.

Subscriptions, Billing, and Cancellation

Part of Whisper is free. Continuing past a certain point in a case requires an auto-renewing subscription, which unlocks the paid cases and questions available at that time.

The plans available, their billing periods, and their prices are shown in the app before you buy, and on your app store listing. Prices differ by platform and by country, and taxes may apply. The price and billing period shown to you at the moment of purchase are the ones that govern.

The following apply to every subscription:

• Payment is charged to your App Store or Google Play account when you confirm the purchase.
• Your subscription renews automatically at the same price for the same period unless you turn off auto-renewal at least 24 hours before the end of the current period.
• Your account is charged for the renewal within the 24 hours before the current period ends.
• You can view, manage, or cancel your subscription and turn off auto-renewal in your account settings on the App Store or Google Play. Deleting the app does not cancel a subscription.
• Cancelling stops future charges. It does not refund the period you are already in, and your access continues until that period ends.

Refunds are handled by Apple and Google, not by us, under their own policies — we cannot issue or reverse a charge made through their stores. If you believe you were charged in error, contact the store you purchased from. You may also write to us and we will help where we can.

We may change our prices or the plans we offer. A change never affects a period you have already paid for, and a price change to a renewing subscription takes effect only after you are notified as your app store requires.

What You May and May Not Do

Whisper is licensed to you, not sold. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own entertainment. You may not:

• copy, sell, rent, sublicense, or redistribute the app or any case content;
• reverse engineer, decompile, or attempt to extract source code, case answers, or unreleased content, except to the extent that applicable law expressly permits it;
• use scripts, bots, or automated tools against the app or our servers, or submit answers at a volume no person could;
• interfere with, overload, or attempt to gain unauthorised access to our servers or to another player’s device or account.

What You Type

When you submit an answer, the text you typed is sent to our server so it can be graded, and may be graded with the help of a third-party language model. You give us permission to process and store that text for that purpose and to improve how answers are graded, as described in our Privacy Policy. Do not type personal information, or anything you would not want stored, into an answer box.

Our Content

The app, the cases, the artwork, the writing, and the name Whisper are owned by us or licensed to us, and are protected by copyright and other laws. These Terms give you no right to use our name or branding.

Availability and Changes

We may add, change, or remove cases, questions, and features, and we may suspend or discontinue the app. We try not to remove content you have paid to reach, but a case may have to change or be withdrawn — for a rights issue, for example. If we withdraw the app entirely while your subscription is running, you may ask your app store for a refund of the unused portion.

Disclaimers

Whisper is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that answer grading will always be correct. Grading is automated and can get an answer wrong; where that happens, the remedy is the hint and skip options inside the app, not compensation.

Nothing in a case is advice of any kind, and nothing in Whisper is a statement of fact about any real person, business, or event.

Limitation of Liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of Whisper. Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or US$50.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

Ending Your Use

You may stop using Whisper at any time by deleting it, and cancelling any subscription through your app store. We may suspend or end your access if you breach these Terms, in particular the section above on what you may not do.

Changes to These Terms

If we change these Terms we will update the date at the top of this page, and where the change is significant we will say so in the app. Continuing to use Whisper after a change means you accept the updated Terms.
